Terms of Service

1. Acceptance of terms

By accessing or using Kitt ("the Service"), operated by Discovery Kitchen ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

Kitt is a marketing analytics platform that connects to your advertising platforms (Meta Ads, Google Ads, TikTok Ads) and e-commerce systems (Shopify, Razorpay, Shiprocket, Google Analytics 4) to aggregate, display, and analyse your performance data. The Service includes automated data syncing, goal tracking, alerts, and AI-generated insights.

3. Account registration

You must create an account to use Kitt. You agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@discovery-kitchen.com if you suspect unauthorised access.

4. Authorised use of platform credentials

By connecting an advertising or e-commerce platform to Kitt, you confirm that:

• You are authorised to grant Kitt access to that account
• You have read and agreed to the terms of service of that platform
• You will only connect accounts belonging to you or your clients, with their consent

Kitt accesses third-party platforms strictly to provide you with the analytics service. We do not make changes to your ad accounts, campaigns, or store settings unless explicitly instructed by you.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to other accounts or systems
• Reverse-engineer, decompile, or copy any part of the Service
• Use the Service to process data you are not authorised to access
• Resell or redistribute the Service without our written consent

6. Subscription and billing

Paid plans are billed monthly or annually in advance. Prices are displayed on the pricing page. We use Stripe to process payments; card details are never stored on our servers.

You may cancel your subscription at any time through your billing settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods.

We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.

7. Data ownership

You own your data. Kitt does not claim ownership over the advertising data, sales data, or any other data pulled from your connected platforms. We store it on your behalf to provide the Service.

We may use anonymised, aggregated data (with no personally identifiable information) to improve the Service. We will never sell your individual data to third parties.

8. AI-generated insights

Kitt uses the Anthropic Claude API to generate analytical insights. These are informational only and should not be relied upon as financial, legal, or business advice. AI outputs can be inaccurate — always verify important decisions against your primary data sources.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, platform outages, or events outside our control. We are not liable for losses arising from service interruptions.

Data sync accuracy depends on the APIs provided by third-party platforms (Meta, Google, Shopify, etc.). We are not responsible for inaccuracies in data returned by those APIs.

10. Limitation of liability

To the maximum extent permitted by law, Discovery Kitchen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of business, arising from your use of Kitt or inability to use the Service.

Our total liability to you for any claims arising out of or related to these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you breach these terms, engage in fraudulent activity, or if we discontinue the Service, with reasonable notice where possible.

On termination, your access to the Service will cease. You may request a data export within 30 days of termination; after that, your data may be deleted.

12. Governing law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

13. Changes to these terms

We may update these terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
